1. Booking and Payment
The Photographer (Jen O’Sullivan) agrees to preform the professional photographic services for the wedding of _________________________________ on _______________________ at _______________________________ from _________________________.
Please mail the signed photo agreement along with the specified non-refundable (transferable) booking fee of $1,000 to: Jen O’Sullivan (address here.) Final payment of $______________ is due one week prior to the event date on __________________________. Should a delay occur with final payment, the event will be photographed and all photography will be held until 2 weeks after payment has cleared.
2. Service Guarantee
Jen O’Sullivan Boutique Wedding Photography (JOBWP) guarantees its services up to but not to exceed the photographic fees paid by the client to JOBWP. Services include the digital photographing of the above event by Photographer (Jen O’Sullivan) at the above specified time and place for the above amount of time with the use of Jen as the principal photographer and one assistant photographer (optional and contracted).
3. Exclusivity
Jen O’Sullivan Boutique Wedding Photography shall be the exclusive photographer retained by the client for the purposes of photographing the wedding. Family and friends of the client shall be permitted to photograph the wedding as long as they not interfere with the Photographer’s (Jen O’Sullivan) duties and do not photograph poses arranged by the Photographer (Jen O’Sullivan).
4. Delivery
Photos will be available for viewing 3-4 weeks after the event and online proofing for client, family, and friends will be available through PICTAGE for 3 months. Purchases made through PICTAGE are guaranteed only by PICTAGE and not through JOBWP and its photographers. See PICTAGE Terms of Service for more details. Once the photo come offline, the client will be given one DVD archive of all images (edited) photographed during the above event along with a proof book of all images. The DVD archive and proof book of the event will be mailed via regular mail through the United States Postal Service (USPS). JOBWP is not responsible for delays due to the USPS. Should your DVD archive arrive damaged or unreadable, JOBWP will re-archive the event and have it shipped via the USPS within 5 business days of being notified of said damage.
5. Copyright
All photography copyright © by Jen O’Sullivan and Jen O’Sullivan Boutique Wedding Photography (JOBWP). The Photographer (Jen O’Sullivan) and JOBWP reserves the right to use any photographs taken during the event for advertising and commercial use. The event may be posted on the JOBWP website with samples from the wedding and/or used for promotional and marketing materials. Should the client not wish to have their event uploaded to the internet for viewing or a sample placed on the JOBWP website or used in marketing materials, a request must be made prior to the event in writing.
6. Cancellation
Should an event be cancelled due to the fault of the client, JOBWP reserves the right to keep any booking fee made by the client. The client may request a full “opt out” of the agreement no less than 4 months prior to the event. If it is less than 4 months to the time of the event, the photographer requires 50% of the total fees. If the event is cancelled within one week of the event the photographer requires 75% of the total fees.
7. Failure to Perform
If the Photographer cannot perform this agreement due to fire, casualty, act of God, or other cause beyond the control of the parties, then the Photographer shall return all monies paid to the Photographer and shall have no further liability with respect to the agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of the Photographer. The Photographer makes every effort to keep any of the above from happening. No specific photograph is guaranteed.
8. Client Usage Rights
The Client is granted limited usage for an unlimited amount of time of all photographs for private and personal use only. Image files are non-transferable and cannot be given, shared, or sold to any third party. Web sharing of low resolution imagery is okay but must contain photo credit and the file size must be no bigger than 4×6 inch at 72dpi. Credit must read: “Photo by Jen O’Sullivan” Please bring this contract to any photography lab for proof of usage rights. Commercial use is strictly prohibited and punishable by a fine of no less than three times the commercial usage worth of the photo which is unlawfully used.
